Some quick definitions to common estate terms:
- Probate - The formal legal process that gives recognition to a will and appoints the executor or personal representative who will administer and distribute assets to the intended beneficiaries.
- Beneficiaries - A person or group named to receive proceeds, income of an estate, or someone who will be receiving some benefit from the estate.
- Assets - Any resource with economic value that an individual owns or controls. An example would be property owned by a person, regarded as having value.
- Letters Testamentary - When a person is nominated as personal representative in someone's will, the court will order the clerk to issue "Letters Testamentary" in the their name. An important step to acquire prior to handling the settlement of an estate.
- Equity - Financially speaking, equity is the remaining value after all liabilities have been paid. When considering equity in a home, take the market value for the sale of the home, minus any mortgages, debts, or other fees that are necessary to sell the property (taxes, title, escrow, etc).
- Transfer of Property - Transfer is an act of which title of a property is voluntarily conveyed from one person to another, typically in the form of a sale, money transfer, and is recorded with the County the property is located.
